3. Village Academy Easement
   Motions:
   

   I recommend the School Board approve entering into a Cross-Easement Agreement with the Auburn Trace, Ltd., over a portion of the Village Academy campus, as herein described; and authorize the Chairman and Superintendent to sign all necessary documents.	-	PASS
   Minutes: The easement will provide for off-site stormwater retention needed for the Village Academy expansion project. The easement also encumbers the stormwater culvert that runs through the Village Academy campus to allow for overflow stormwater discharge when the retention area is full. The School Board is responsible for constructing all of the drainage facilities required by the South Florida Water Management District (SFWMD) permit, including raising the berm on the south side of the Auburn Trace property. Immediately after the easement is granted, the parcel that includes the stormwater retention area will be sold by Auburn Trace to the City of Delray Beach. The easement requires that upon the completion of the drainage facilities, each party is responsible for maintaining and repairing the facilities on their respective parcels in compliance with the SFWMD permit. For the Record: Mrs. Burdick is unable to support this recommendation because she was not provided adequate time to review and feels the financial impact is not clear.
